Who Can Apply for Letters of Administration?

If someone dies without a valid Will (intestate), you may need to apply for letters of administration to legally manage and distribute the deceased’s estate.


In Australia, the law sets out who has the right to apply for letters of administration. Generally, the person with the closest relationship to the deceased—and the largest entitlement under intestacy laws—has priority.


Below is an overview of who can apply for letters of administration in Australia:
